In none of the paragraphs of the writ petition, the petitioner submits that pursuant to the call letter issued, he has appeared in the Physical Standard Test held on 13.08.2016. The submission of the petitioner that he has fulfils all other criteria and has obtained higher marks than the last selected candidate, therefore, cannot be accepted.
At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw the writ petition with the liberty to file afresh.
In view of above submission, the writ petition is dismissed as withdrawn with the liberty to file afresh writ petition with correct details.
