High Court Of Judicature at Allahabad|29 May, 2018
|

JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 2996 of 2018 Applicant :- Karan Singh Opposite Party :- Hemant Kumar, D.M. And 4 Other Counsel for Applicant :- Brajesh Shukla
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
This petition alleges disobedience of an order of status quo with regard to possession issued by the learned Judge on 1 August 2008.
The sole allegation on which this petition is pressed is that the opposite parties have cut down his standing crops and therefore violated the injunction issued by the Court. This Court finds itself unable to either sustain this submission or to initiate proceedings on this basis for the simple reason that the order of status quo was restricted in its application to possession only. If the allegation be that standing crops have been cut down, the same though may amount to criminal tresspass or damage to property, it cannot possibly be viewed as a violation of the order of injunction.
The petition is dismissed.
Order Date :- 29.5.2018 Arun K. Singh
