Heard Sri Mukesh Kumar, learned counsel for the applicant and Sri Purshottam Maurya, learned A.G.A. for the opposite party No.1.
This application under Section 482 of Cr.P.C. has been filed seeking quashment of impugned Non Bailable Warrant dated 2.08.2018 passed by Chief Judicial Magistrate, Kasganj in Case Crime No. 312 of 2016, under Sections 379 and 411 I.P.C., Police Station Patiyali, District Kasganj.
Allegation in the present petition is to the issuance of Non Bailable Warrant against the applicant on 2.08.2018. Learned counsel for the applicant submits that one opportunity be granted to the applicant to appear before the concerned Court and to file appropriate application seeking cancellation of Non Bailable Warrant. He submits that till such exercise is being done, applicant may be protected.
On the other hand, State Counsel has no objection to this proposition.
Considering the facts and circumstances of the case, the applicant is directed to appear before the court below and to file appropriate application seeking cancellation of Non Bailable Warrant within four weeks.
Till four weeks from today, no coercive steps shall be taken against the applicant in the aforesaid crime number.
