This anticipatory bail application u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Kaptan Singh in the event of his arrest in Case Crime No.364 of 2019, under Sections 420, 467, 468 and 471 I.P.C. P.S. Pharah, District Mathura.
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The allegation against the applicant with regard to fraud and forgery appears to be very serious. Learned counsel for the applicant has not been able to point out any such justification or explanation which may be considered in his favour at this stage. This Court does not propose to make any observation about the merits of the case which may cause prejudice to either side. Suffice it to observe that in a matter like this the custodial interrogation of the accused-applicant appears to be necessarily essential and this Court does not want to put a spanner in the investigation which must operate independently in accordance with law and be allowed to have its full swing and bring the guilty to book. No good ground for grant of anticipatory bail in favour of the applicant is made out.
Accordingly, the anticipatory bail application is rejected.
It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
