Heard counsel for the applicant, learned A.G.A. and perused the record.
Learned counsel for the applicant submitted that the application was given for allotment of flat advertised and constructed by complainant opposite party no.2. There was complaint regarding the quality of the construction and the project was not completed, hence notice was given through E-mail and on Facebook. Thereafter complaint has been filed under section 500 I.P.C. However, without application of mind the Magistrate concerned summoned the applicant.
Issue notice to the opposite party no.2 returnable at an early date.
List along with application u/s 482 Cr.P.C. No. 24898 of 2014 after six weeks.
Till the next date of listing, further proceeding of Complaint Case No.584 of 2014 under section 500 I.P.C. read with section 120B I.P.C. PS.I ndirapuram, District Ghaziabad shall remain stayed.
