Heard learned counsel for the petitioner and Sri Abhishek Mishra, for the Bank, respondent no.4.
Admittedly petitioner has defaulted in repayment of an agricultural loan taken from the respondent-Bank. A recovery certificate, dated 20.8.2019, for recovering of Rs. 2,20,703/- has been issued.
Petitioner submits that he is ready to deposit whole of the amount in easy installments.
Learned counsel for the respondent Bank has no objection.
Under the circumstances, this petition is disposed of directing the petitioner to deposit the amount sought to be recovered in four equal quarterly installments. The first installment shall necessarily be deposited within a period of one month from today. After payment of first instalment, the bank shall furnish statement of account to the petitioner.
In case petitioner commits default in depositing any of the installments within the stipulated time, it will be open to the respondents to adopt coercive process which will not be objected to by the petitioner.
Subject to the above, this writ petition stands, disposed of.
