JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule. Mr.Pandya, learned APP waives service of notice of Rule for the respondent State.
By way this application, the applicant - convict has prayed that he be enlarged on temporary bail to see his family members like mother, etc. From the jail remarks we find that the applicant - convict, who is undergoing sentence for the offence punishable under Section 302 read with Section 498(A) of IPC, has hardly undergone one year's sentence by this time.
Under these circumstances, discretion does not deserve to be exercised. Hence, the application is rejected. Rule discharged.
