Heard learned counsel for the parties.
The petitioner claims that he is a president of Bhagyanagar Citizen Welfare Association, Sriram Nagar Colony, Gowlipura, Hyderabad and according to him, there were 165 members in the said association and they were granted JNNURM house site pattas in Ex-Servicemen colony, Uppuguda, Hyderabad in the year 2000, but physical possession was not delivered to them. They had made an application on 5.9.2012 requesting the sixth respondent-
District Collector to allot the house sites to genuine beneficiaries only, instead of non-locals and illegal beneficiaries. The petitioner further states that the association made a representation on 28.1.2013 seeking to allot physical possession to genuine beneficiaries in Sy.No. 83 and delete the non-locals and illegal beneficiaries from out of the list of 230 beneficiaries. Alleging inaction on the said representation, the present writ petition is filed.
This writ petition was dismissed for non-prosecution on 14.8.2013 and it has since been restored to file, on 6.6.2014. The representation of petitioner’s association dated 28.1.2013 as well as its earlier representation dated 5.9.2012 is stated to be pending with the sixth respondent. Since the said representations were made by the Welfare Association, the present writ petition filed by its President cannot be taken cognizance of.
However, the Welfare Association is at liberty to approach the sixth respondent by making a fresh representation on the subject keeping in view the subsequent developments and seek appropriate remedy from him. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
