Kanubhai vs Manojkumar

High Court Of Gujarat|09 April, 2012

JUDGMENT / ORDER

Learned advocate for the applicant has contended that the applicant was in fact original informant and he has not been joined as party respondent in the quashing petition filed by the opponent original petitioner in CR.M.A. No.585 of 2012.
The Court is of the considered view that no harm is likely to happen in case the applicant is permitted to join as a party respondent. Therefore, the application is allowed. The applicant is joined as party respondent in Cr.M.A. No.585 of 2012.
At this stage, Shri Brahmbhatt, learned advocate for the newly added party makes a request that the main matter be fixed for hearing in the first week of May, 2012 and submits that he would not object to continuation of the earlier order under which the petitioner was entitled to seek adjournment of the proceeding before the Court below.
In view of this, the main matter is ordered to be kept on 02.05.2012. Office is directed to amend the cause title accordingly.
