1. Present Civil Application has been filed by the applicants for condonation of delay of 209 days in filing the aforesaid first appeal on the grounds stated in the application, inter alia, that the applicants were making the arrangement for resources for payment of court fees and the fees of the advocate to file appeal in the High Court, which caused the delay.
2. Heard learned advocate Mr. Prajapati for the applicants and learned AGP Mr. Devang Dave for the respondent-State.
3. In view of the grounds mentioned in the application, it appears that sufficient cause is made out for condonation of delay. It is well accepted that Hon'ble Apex Court by catena of judicial pronouncement has also laid down the guidelines with regard to the pragmatic approach in such matters for condonation of delay.
4. Hence, present Civil Application deserves to be allowed and accordingly stands allowed. Prayer in terms of para-4(A) is granted. Rule is made absolute.
