Heard Mr.Jayesh Patel for Mr.A.J.Patel, learned advocate for the applicant-original petitioner, and Mr.Zala for Mr.Dipen Dave, learned advocate for the opponents-original respondents. With consent of the parties, the matter is taken up for final hearing today.
The applicant has preferred the present application for bringing the legal heirs of original respondent No.2-Dhuliben Bhikhabhai on record of the main petition. As averred in the application, the original respondent No.2 expired on 11.04.2005.
Considering the averments made in Paragraph Nos.2 and 3 of the application, the application deserves to be accepted. Mr.Zala, learned advocate for the opponents, have no objections if the application is accepted and the prayers prayed for in Paragraph No.4 of the application are granted.
In view of the above, the application stands allowed. Rule is made absolute accordingly. There shall be no order as to costs.
