On 15.09.2004, this Court (Coram: Ravi R. Tripathi, J) has passed following order:-
Mr.
G.M. Das, learned Advocate for the petitioner, states that an affidavit explaining the cause for delay in challenging the award, is already sent for affirmation. He is awaiting return of the same. To enable him to file the said affidavit, the matter is adjourned to 29.04.2004.
On 16.09.2010, this Court (Coram: M. R. Shah, J), has passed following order;-
When the petition is taken up for hearing, Shri Das learned advocate for the petitioner is absent. However, in the facts and circumstances of the case, S.O. to 06.12.2012.
On 27.11.2012, this Court has passed following order ;-
In view of the sick note of learned counsel for the petitioner, S.O. to 11.12.2012.
On 11.12.2012, this Court has passed following order ;-
In view of sick note and leave of both sides, S.O. to 26.12.2012.
Even today, Mr Das learned Advocate for the petitioner has filed a sick note. In the interest of justice, the matter is adjourned to 17th January, 2013.
It is made clear that if Mr. Das is not in a position to attend the Court, he will make alternative arrangement by the next date of hearing, otherwise, on the next date of hearing, the matter will be proceeded ex-parte, even in absence of Mr. Das.
