Heard Mr.R.J.Goswami, learned advocate for the applicant and perused the relevant papers annexed with this application.
Mr.R.J.Goswami, learned advocate for the applicant read over the F.I.R.-Annexure-A and submitted that so far as the offence punishable under Section 308 of the Indian Penal Code alleged in the F.I.R. is concerned, not a single ingredient constituting said offence can be said to have been made out from the F.I.R.
In above view of the matter, this application requires consideration. Hence, RULE returnable on 16th April,2012.
In the meanwhile, there shall be interim stay in terms of Para-8(b) of this application. Direct Service is permitted.
