The prayer made in the instant petition is for a mandamus commanding the respondents to pay compensation amount awarded in favour of the petitioner by respondent no.2 by order dated 12.2.2020 under Section 28-A of the Land Acquisition Act, 1894.
On 25.8.2021, we required the learned Standing Counsel appearing on behalf of State and learned counsel appearing for Varanasi Development Authority, Varanasi to obtain instructions whether the payment has been made or not.
On matter being taken up today, Sri Ravi Prakash Pandey, learned counsel appearing on behalf of Varanasi Development Authority, Varanasi informs the Court that the entire amount due and payable to the petitioners under award dated 12.2.2020 has been deposited by means of a cheque dated 20.09.2021 in favour of the Special Land Acquisition Officer, Joint Organization, Varanasi.
The instructions furnished by Varanasi Development Authority, Varanasi are taken on record and a copy thereof has also been handed over to learned counsel for the petitioners.
Having regard to the above development, we dispose of the writ petition with liberty to the petitioners to move proper application before respondent no.2 for release of the amount which has now been deposited by Varanasi Development Authority, Varanasi. The application shall be processed without delay.
