Heard Sri Satyendra Narayan Singh, learned counsel for the petitioners and Sri Shambhu Chopra, learned counsel for the respondent no. 2.
It is informed that Sri Arvind Kumar Goswami, who has filed his memo of appearance on behalf of Union of India on 03.01.2019, is in some personal difficulty, therefore, he is not present today.
The petitioners in the writ petition are seeking quashing of the communication dated 03.12.2018 which requires the cable operators to maintain sufficient balance to recharge the customers as per the new guidelines failing which the services to the defaulted STBs would be suspended from 18.12.2018.
It is not clear as to who has issued this circular and if at all it is a circular, it does not mention any circular number or the authority which has issued it.
The matter requires consideration.
Issue notice to the respondents no. 4 & 5, returnable within three weeks.
Steps be taken by registered post within a week.
All the respondents may file their counter affidavit within four weeks.
List on 22 February, 2019.
Till the next date of listing, the parties shall maintain status-quo in respect of the impugned communication dated 03.12.2018.
