The court below passed an order of temporary injunction restraining the defendants and their agents from using the trade name 'Pai Dosa' or 'Pai Thattu Dosa' till the disposal of the suit. 2. The defendant has filed an application for review of the order of temporary injunction on the finding of the court below that 'Pai Dosa' is a common name and not a generic term. The petition for review is accompanied by an application for stay of operation of the order of temporary injunction.
3. I direct the Court of the Vth Additional District Judge of Ernakulam to consider I.A. No. 1624/2014 for review and I.A. No. 1625/2014 for stay of operation. Every endeavour shall be made to pass orders thereon within a period of two weeks from today. The parties shall maintain status-quo till such time.
The Original Petition is disposed of.
