M/S.Kannamthanam vs State Of Kerala

High Court Of Kerala|12 November, 2014

JUDGMENT / ORDER

The review petition is filed seeking a review of the judgment dated 27.5.2014 in W.P.(C).No.12193/2014, whereby the writ petition was dismissed as infructuous based on the submission of counsel for the petitioner that the writ petition had become infructuous. It is now pointed out by counsel for the petitioner that the submission regarding the matter having become infructuous was made under the bona fide belief that the period mentioned in Ext.P2 order for its validity, had come to an end by 15.5.2014. It is submitted that the petitioner was not aware of the fact that, by another order dated 15.5.2014, the validity of Ext.P2 order had since been extended until further orders. It is under these circumstances that he seeks review of the judgment dated 27.5.2014 in W.P.(C).No.12193/2014. 2. I have heard Sri.Enoch David Simon Joel, the learned counsel appearing on behalf of the petitioner as also Smt.Sunitha Vinod, the R.P.NO.826/2014 IN 2 W.P.(C).NO.12193/2014 learned Senior Government Pleader appearing on behalf of the respondents.
3. Considering the submissions of counsel for the petitioner, with regard to the circumstances under which he had stated that the matter has become infructuous, I am inclined to recall the earlier judgment dated 27.5.2014 in W.P.(C).No.12193/2014. I do so.
The review petition is allowed as above.
