It is jointly submitted by learned advocates for the respective parties that if necessary direction is given to learned Trial Court to dispose of the Special Civil Suit No.63 of 2008 within stipulated time, then, they do not invite any reasoned order. It is assured by learned advocates appearing for the respective parties that that they will give full cooperation for expeditious disposal of the suit.
[2] Under the circumstances, learned Additional Senior Civil Judge, Surat is hereby directed to dispose of Special Civil Suit No.63 of AO/243/2011 2/2 ORDER 2008 preferably within a one year from the date of receipt of present order. It is clarified that learned Trial Court shall dispose of the suit in accordance with law and without being influenced by the order passed by this Court today.
[3] In view of above, the Appeal from Order is disposed of. No order in Civil Application and same is accordingly disposed of.
