Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with following prayer:-
"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to direct the Up Zila Adhikari, Sikandarpur, Ballia (respondent No. 2) to decide the Election Petition No. T- 202115090201908 under section 12 (Ga) of U.P. Panchayat Raj Act readwith U.P. Panchayat Raj Election Dispute Settlement Rules-1994 within stipulated period so that the justice may be done; otherwise the applicant / petitioner shall suffer irreparable loss and injury. "
The election petition has been filed very recently in June, 2021 itself. This petition was reported on 2.7.2021. The order-sheet has not been annexed to indicate that the Election Tribunal is not proceeding with the matter.
At this stage, learned counsel for the petitioner submits the present petition may be dismissed as withdrawn.
Accordingly, present petition stands dismissed as withdrawn at this stage.
