JUDGMENT / ORDER

Hon'ble Karuna Nand Bajpayee,J.
Heard learned counsel for the appellant and learned Additional Government Advocate and perused the record of the case.
Learned counsel for the appellant submitted that the appellant has been in jail for about eight years and six months and there is no prospect of an early hearing of the appeal. The incident took place on a sudden quarrel between the deceased and appellant while they were watching the dance. The appellant gave knife blows to the deceased.
Per contra, learned A.G.A opposed the prayer for bail, but he could not dispute the facts of long detention of the appellant in jail.
Having given our thoughtful consideration to the submission of learned counsel for the parties and without expressing any opinion on the merits of the case at this stage, we are of the view that the appellant has made out a case for bail.
Let the appellant Kanhaiya Singh @ Dabloo Singh convicted and sentenced in S.T. No. 246 of 2004, under sections 302 I.P.C., P.S. Rewti, district Ballia be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of court concerned,on deposit of half of the fine amount within a period of one month.
