Petitioner claims to be the senior most Class -IV employee and thereby seeks entitlement for promotion to Class - III post of Assistant Clerk in the Institution. It is stated that there are two posts of Assistant Clerk in the Institution and one is already filled by direct recruitment. Petitioner states that being senior most person, his claim for promotion, in terms of Regulation 2, Chapter-III of the U.P. Intermediate Education Act, 1921, is liable to be examined by the competent authority, but no decision has been taken, as yet.
From the facts and circumstances, noticed above, this petition stands disposed of with a direction upon the respondent no. 2 to accord consideration to the petitioner's claim for promotion in terms of Chapter-III, Regulation 2 of the 1921 Act, after affording an opportunity of hearing to the respondent no. 3 to 5. Required consideration would be made within a period of four months, from the date of presentation of a certified copy of this order, by a reasoned order.
