Heard learned counsel for the petitioner and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioner have prayed for following relief as substantial one :-
"(i). issue an order or direction in the nature of directing the learned Additional District Judge, Room No. 20, Allahabad to decide the Execution Case No. 03 of 2020 (Kanhaiya Lal Jaiswal v. Rajendra Kumar Chaurasia) as expeditiously as possible or within the stipulated period as fixed this Hon'ble Court."
Learned counsel for the petitioner submits that the defendants have appeared in this case.
Accordingly, the writ petition is disposed of with a direction to the court concerned to consider and decide the aforesaid Execution Case No. 03 of 2020 (Kanhaiya Lal Jaiswal v. Rajendra Kumar Chaurasia) and in case application under Section 47 of Code of Civil Procedure is filed the same shall also be considered before concluding the execution case, strictly in accordance with law and after recording satisfaction regarding service of summons and after giving full opportunity of hearing to all the parties concerned, as expeditiously as possible preferably within a period of six months from the date of production of copy of this order.
It is clarified that the procedure prescribed for deciding such suit, shall be religiously complied with and priority shall be fixed in the order in which other pending suits, if any, have been expedited by this Court in the past.
Copy of the order available on the official website of the High Court will be taken to be authentic one.
