Heard Sri Shailendra Kumar Tripathi, learned counsel for the petitioner and Sri J.K. Upadhyay, learned A.G.A. for the respondent nos. 1 and 2.
This writ petition has been filed by the petitioner seeking quashment of FIR dated 09.08.2018 in respect of Case Crime No. 234 of 2018 for the offence under Sections 457, 380, 427 I.P.C., P.S. Tathiya, District Kannauj.
Considering the allegations levelled against the petitioner, we are not inclined to interfere in the present writ petition.
However, if the petitioner appears before the trial court and files regular bail, the competent court shall decide the said bail application expeditiously in accordance with law.
The trial court is further obliged to collect the information about the criminal antecedents of the petitioner.
It is made clear that we have observed nothing on the merits of the case and the trial court would be at liberty to decide the case in accordance with law.
The trial court would be further obliged to consider the judgment cited by the parties in their favour.
The writ petition is accordingly disposed of.
