This writ petition has been filed by the petitioner with the prayer :
(i) Issue a writ, order or direction in the nature of mandamus, commanding the respondent no. 4 to decide the representation dated 06.05.2019 (Annexure-3 to the writ petition) of the petitioner within stipulated time granted by this Hon'ble Court.
(ii) Issue any other suitable writ order or direction which this Hon'ble Court may deem just and proper under the facts and circumstances of the case.
(iii) Award the costs of the petition in favour of the petitioner.
Upon perusal of the averments made in the writ petition and the documents appended thereto, it transpires that the petitioner has filed a representation before the respondent no. 4, Commissioner, Moradabad Mandal Moradabad on 6.5.2019 with the prayer that he may be intimated the name of the authority concerned which has acquired his land (Annexure-3 to the writ petition) The grievance of the petitioner appears to be that despite lapse of more than three and a half month, the representation filed by the petitioner before the respondent no. 4 has not been decided till date.
In view of the above, without expressing any opinion on the merits of the case, we dispose of this writ petition with liberty to the petitioner to file a fresh comprehensive representation ventilating all his grievances before the respondent no. 4, Commissioner, Moradabad Mandal Moradabad within a period of three weeks from today along with certified copy of this order and in case any such representation is filed by the petitioner before the respondent no. 4 within the time indicated hereinabove, he shall consider and decide the same strictly in accordance with law by a speaking and reasoned order as expeditiously as possible preferably within a period of two months from the date of filing of such representation by the petitioner before him.
