JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE EIGHTEENTH DAY OF TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 20206 of 2014 BETWEEN Kandrathi Sambasiva Rao AND ... PETITIONER The State of Andhra Pradesh, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS Counsel for the Petitioner: MR. V.SAI KUMAR Counsel for the Respondents: GP FOR SOCIAL WELFARE (AP) GP FOR REVENUE (AP) The Court made the following:
ORDER:
Petitioner, who is given a notice by the District Level Scrutiny Committee to appear on a particular date, states that he could not attend on that day, but he has sent a fax message requesting extension of time for eight weeks. The present writ petition is filed with a grievance that on such fax given on 07.07.2014, the request is not accepted by the Scrutiny Committee and the orders are reserved. Hence, the relief sought for in the present writ petition is to reopen the enquiry and permit the petitioner to consider the case of the petitioner for pleading evidence.
Admittedly, no orders are passed by the District Level Scrutiny Committee, Guntur as on now. Nothing prevents the petitioner from approaching the said Committee and making a request in person to reopen the matter. The present writ petition, in my view, is wholly incompetent at this stage.
With the liberty to the petitioner, as aforesaid, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
VILAS V. AFZULPURKAR, J July 18, 2014 LMV
