JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE C.V. NAGARJUNA REDDY CONTEMPT CASE No.332 of 2014 Dated: 27.06.2014 Between:
Smt. Kandlagunta Sujatha and another.
.. Petitioners And Sri Ch. Hanumantha Rao. .. Respondent Counsel for the applicant: Smt. N. Rama Kumari for Mr. G.L. Nageswar Rao Counsel for the respondent: Mr. G. Elisha The Court made the following:
ORDER:
This contempt case is filed alleging willful disobedience of order dated 10.07.2013 in W.P.No.17482 of 2013.
By the above-mentioned order, this Court, while permitting the petitioners to make a written representation giving details of the works executed by them, directed the respondent herein (respondent No.4 in the writ petition) to examine the same and pay the amounts, if any, due to the petitioners within two months of the petitioners making the representations.
The petitioners alleged that they have made a detailed representation to the respondent herein on 18.10.2013 followed by another letter dated 07.11.2013 and that as no action was taken by the respondent, a legal notice was issued on their behalf on 27.01.2014. The petitioners further alleged that despite the direction given by this Court, the respondent has not considered their claim and made payments.
The respondent filed a counter-affidavit, wherein he has inter alia stated that on receipt of the representation from the petitioners, he has addressed letter 28.10.2013 to the Gram Panchayat for implementing the order of this Court by releasing the amounts payable to the petitioners after examining the records. That pursuant to the said letter, the Secretary of Vallur Gram Panchayat has placed the issue before the committee of Gram Panchayat for necessary action for releasing the money to the petitioners, that on 29.10.2013, the committee of Gram Panchayat convened general body meeting and resolved for verifying the accounts pertaining to the works executed by the petitioners for payment of dues to the petitioners and that it has also further resolved that appropriate action will be taken in the next meeting. He has further stated that the committee has so far not taken a final decision, that the Panchayat Secretary has addressed letter dated 18.06.2014 to the District Panchayat Officer, Prakasam District, requesting for issuing appropriate directions to the Sarpanch, Vallur, for releasing the amounts to enable the Gram Panchayt to pay the same to the petitioners.
The above-noted averments in the counter-affidavit show that the respondent herein has taken all the necessary steps that are required for implementing the order of this Court. Therefore, I do not find any reason to believe that the respondent has violated the order of this Court intentionally or otherwise. If the petitioners have any grievance against the other respondents in the writ petition including the Gram Panchayat, they shall be free to avail appropriate remedy for enforcing the order of this Court.
The contempt case is accordingly dismissed with liberty to the petitioners in terms of the observations made hereinbefore.
