JUDGMENT / ORDER

Petitioners are the residents of the State of Tamil Nadu and are aggrieved by the purported action of the 3rd respondent, as indicated in Ext.P3 series, wherein, there is a refusal to collect milk from them. The petitioners' contention is that, they have been in fact supplying milk to the 3rd respondent for long and the prohibition effected affects their livelihood and is not based on any valid reasoning. The petitioners' grievance is built upon the premise that the direction, not to collect milk from the other States, would go against Article 301 of the Constitution of India. This Court does not perceive any such violation, since, embargo is not intended at collecting milk from other States, but confining the collection to the area of operation of the Societies.

2. Specific directions were issued only since, 3rd respondent Society has area of operation close to the border of the State and hence, the supply of milk from persons outside the area of operation was sought to be interdicted.
3. The learned Government Pleader submits that, there were wide-spread allegations of adulteration of milk and this prompted such prohibition. This Court is not inclined to invoke the extra ordinary jurisdiction under Article 226, to cause interference.
The writ petition is hence dismissed; in limine.
