Heard learned counsel for the petitioners and Shri Rajesh Kumar, learned Standing Counsel.
The petitioners are before this Court assailing the order dated 22.5.2018 passed by second respondent in Revision No.44 of 2018-19 (Kanchi Singh & Ors. v. State of U.P. & Ors.) and the order dated 16.2.2018 passed by respondent no.3 and for a direction to the respondents not to interfere in the peaceful possession of the petitioner over the property in question.
Learned Standing Counsel raised an objection that the petitioners had earlier been before this Court assailing the order dated 16.2.2018 passed by SDO concerned, wherein on the complaint of Gram Pradhan, the proceeding under Section 31/32 of U.P. Revenue Code, 2006 has been finalised, by preferring Writ-C No.9951 of 2018 (Kanchi Singh & Ors. v. State of U.P. & Ors.). The writ petition was disposed of on 4.4.2018 on the ground of alternative remedy of revision under Section 210 of U.P. Revenue Code, 2006. As an interim measure, the Court had provided that in case the petitioners move revision along with stay application within three weeks, the revisional court would decide the injunction application within three months thereafter. Till the disposal of injunction application the parties were directed to maintain status quo. In compliance of the aforesaid order, the revision along with injunction application was filed but the injunction application was turned down. For the violation of the order dated 4.4.2018 the petitioner has also filed contempt proceeding which is also pending consideration. It is contended that once revision in question is pending consideration, as such no interference is required at this stage.
The Court has proceeded to examine the record in question and find substance in the objection raised by learned Standing Counsel. Once revision in question as well as the contempt proceedings are going on, there is no reason or occasion for this Court to intervene in the matter at this stage.
Consequently, the writ petition is dismissed.
