The instant writ petition arises out of proceedings under Section 33/39 of the U.P. Land Revenue Act for correction of papers and seeks quashing of the order dated 21.05.2018 passed by the respondent no.2, Deputy Collector, Khurja, Tehsil -Khurja, District Bulandshahar and the order dated 10.12.2018 passed by the Additional Commissioner, Administration-IIIrd, Meerut Division, Meerut, respondent no.1.
During the course of arguments, counsel for the petitioner has submitted that regarding the property, subject matter of the proceedings for correction of papers, a civil suit is already pending, wherein the petitioner and respondent no.3 are parties.
In my considered opinion, the proceedings under Section 33/39 of the U.P. Land Revenue Act are summary proceedings. The orders passed in these proceedings are subject to the final orders passed the Court in regular title proceedings in view of Section 40A of U.P. Revenue Act.
Under the circumstances, this Court does not find any justification to interfere in the matter.
The writ petition is dismissed with the observation that the orders impugned in this writ petition shall necessarily abide by the orders passed by the Civil Court in the suit, which is admittedly pending between the parties.
