ORDER:
This Writ Petition is filed for a mandamus to declare the action of respondent Nos.1 and 2 in not permitting the petitioner to appear for V Semester of LL.B. course, as illegal and arbitrary.
The petitioner is not present at the hearing.
The Registrar of respondent No.1-University filed a counter affidavit wherein he has inter alia stated that the petitioner did not appear in the I Semester examinations held in March 2013; that in the I Semester examinations held in March 2013, he has passed only in one subject, namely, Environmental Law, out of five subjects and thereby he has left four backlogs; that in the II Semester, the petitioner has appeared in five subjects in September 2013, failed in three subjects and passed in two subjects; that in the II Semester examinations held in March 2014, the petitioner has passed two subjects and failed in one subject; that in the III Semester examinations, he has not appeared and that in the IV Semester examinations held in May 2014, the petitioner has passed in two subjects and failed in three subjects. As per the counter-affidavit, the petitioner has total 13 backlogs in four Semesters.
Along with the counter-affidavit, Rules and Regulations of LL.B. III year degree course of respondent No.1-University have been filed. Clause V of the said Regulations deals with Rules of Promotion. Under sub- clause (5) of Clause V, for promotion from Semester IV to Semester V, the number of backlogs of a candidate in all the four semesters taken together shall not exceed 10 papers/subjects.
In view of the above noted Rule and the fact that the petitioner has 13 backlogs, he is not entitled to appear for V Semester examinations. Hence, the Writ Petition is dismissed.
As a sequel to the dismissal of the Writ Petition, WPMP Nos.39066, 44239 and 45240 of 2014 are dismissed as infructuous.
