The applicant is the wife of opposite party no. 2 who has come up with a prayer to expedite the proceedings of Case No.514 of 2019, Kanchan vs. Amit, under Section 125 Cr.P.C., Police Station Hathras Jn., District Hathras pending in the court of the learned Principal Judge, Family Court, Hathras.
The submission is that the proceedings of the case are pending since the year 2019.
The Court has been taken through the order sheet. A perusal of the order sheet shows that no order of moment has been passed. The proceedings under Section 125 Cr.P.C. have an inherent element of urgency as these are designed to bring immediate relief to a wife or the dependent entitled, who has no means of sustenance.
It is directed that the learned Principal Judge, Family Court, Hathras would do well to expedite the proceedings of Case No.514 of 2019, Kanchan vs. Amit, under Section 125 Cr.P.C., Police Station Hathras Jn., District Hathras and decide the same expeditiously within three months next without granting any unnecessary adjournment to either of the parties.
It is further provided that application for interim maintenance, if any, filed on behalf of the applicant shall be disposed of within a period of one month next positively from the date of receipt of a copy of this order.
With the above orders, this application stands disposed of.
