Heard learned counsel for the petitioner and the learned AGA for the State.
The present writ petition u/s 227 of the Constitution of India has been filed with a prayer to direct the learned Addl. Chief Judicial Magistrate, Court, Court No. 4, Moradabad to decide Execution Case No. 155/11/2017 arising out of Case No. 600/09/2015 (Smt. Kanchan Diwakar Vs. Vikki @ Shashank Diwakar and others), under Section 31 of Protection of Women from Domestic Violence Act, P.S. Civil Lines, District- Moradabad expeditiously within stipulated period.
Learned counsel for the petitioner has submitted that the present proceeding has been pending since 17.8.2017 and has been lingering-on, on one pretext or the other.
In view of the above, the Addl. Chief Judicial Magistrate, Court, Court No. 4, Moradabad is expected to make all endeavours to decide the aforesaid case expeditiously, preferably within a period of four months from the date of filing of certified copy of this order after giving opportunity of hearing to both the parties without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid observations, the writ petition is finally disposed of.
