JUDGMENT / ORDER

Mr. Raval, Ld. APP, upon instructions being received from Mr. PA Raval, PSI, Panthavada Police Station, District Banaskantha, submits that pursuant to the FIR lodged by the petitioner, on 7/2/2012 charge-sheet came to be filed in the Court of Ld. Judicial Magistrate First Class, Dhanera, which was registered as Criminal Case No. 131/2012.
Upon such statement being made, Ms. Rupal Patel, Ld. Advocate for the petitioner, upon instructions, submits that she is not pressing first part of the relief of directing police to proceed further with the investigation, as it has become infructuous. She submits that the later part of the relief prayed in this petition regarding the police protection, she has instructions that in recent past, the petitioner received threats and, therefore, the petitioner shall file his detailed representation seeking police protection before the District Superintendent of Police, Banaskantha, and it is requested that the said representation may be decided by the concerned authority within the stipulated time, which may be fixed by this Court.
In the above view of the matter, the instant application stands disposed of with the direction that if the petitioner is desirous to seek police protection at his cost, he may submit a detailed representation for police protection to the District Superintendent of Police, Banaskantha, and the District Superintendent of Police, shall decide such representation in accordance with law and prevailing rules, as expeditiously as possible, preferably within 15 days from the date of receipt of such representation.
