1. Heard Mr. Majmudar, learned advocate for the petitioner.
2. Mr. Majmudar learned advocate for the petitioner, has placed reliance in the case between Abhijit Ghosh Dastidar v. Union of India & Ors. [(2009) 16 SCC 146] and he has also placed reliance on the order dated 28.11.2011 passed in Special Civil Application No.16580 of 2010. Mr. Majmudar, learned advocate for the petitioner, has submitted that the issue raised in present petition is similar to the issues raised in Special Civil Application No.16580 of 2010.

Mr. Majumdar, learned advocate for the petitioner has submitted that other petition being Special Civil Application No.5945 of 2011 involving identical issue is already admitted and pending for final hearing. He therefore, requested that similar order may be passed in present matter as well. Therefore below mentioned order is passed:-
In view of the above, Rule.
To be heard with Special Civil Application No. 5945 of 2011.
Ad-interim relief, if any, granted earlier to continue until final hearing of the petition or until any further or other order is passed hereinafter. Direct service is permitted.
