JUDGMENT / ORDER

1.0 By way of present petition, the petitioners have prayed to hold that the action of the respondent in not making the petitioner No.1 and other workmen who are working as Safai Kamdar as permanent is arbitrary, illegal and violative of Articles 14, 16 and 21 of the Constitution of India.
2.0 In view of the decision of the Full Bench of this Court in the case of Amreli Municipality v. Gujarat Pradesh Municipal Employees Union, reported in 2004(2) GLH 692, it will be open to the petitioner to raise dispute before the Labour Court or Industrial Tribunal. It will not be appropriate for this Court to entertain this petition. If such a dispute is raised, the same will be considered by the Labour Court or Industrial Tribunal in accordance with law as expeditiously as possible. With this direction the petition stands disposed of.
