JUDGMENT / ORDER

This writ petition has been filed, seeking to direct the first and second respondents to disburse the amount based on the representation dated 01.12.2016, for the supply of Eucalyptus trees.
2.Heard both side. By consent, the writ petition is taken up for final disposal at the stage of admission itself.
3.The learned counsel for the petitioner would submit that the property in question belongs to the petitioner and her sister. As per the agreement dated 15.02.2009 entered into between the petitioner and the first and second respondents, the petitioner supplied Eucalyptus Trees to them. While things stood so, the first and second respondents refused to disburse the amount for the supply of trees citing the pendency of suit in O.S.No.1 of 2015 before the District Munsif Court, Kulithalai, filed by the respondents 3 to 5. Though, the petitioner on 01.12.2016 made a representation to the first and second respondents, the amount has not been disbursed. Hence, the petitioner is before this Court.
4.The learned counsel for the first and second respondents would submit that they are inclined to deposit the amount before the competent civil Court.
5.Such statement of the learned counsel for the first and second respondents is recorded and the said amount be deposited in an interest bearing account in any one of the nationalised banks and be disbursed to the successor in the suit in O.S.No. 1 of 2015, on the file of the District Munsif Court, Kulithalai.
6.With the above direction, the writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
