Heard Mr.C.S.Joshi, learned advocate appearing for Mr. S.B.Joshi, for the applicant. He has read judgment and order passed by the learned trial Judge and contended that the learned Judge has committed grave error. He has read oral evidence of the prosecutrix and contended that when the issue of recording consent is not established then it is the duty of the Court to consider that this is not a case of consent.
