Heard learned counsel for the petitioners and perused the record.
By means of this petition under Article 227 of the Constitution, the petitioner has challenged the order dated 7th July, 2021 by which notices have been issued on the application of temporary injunction against the opposite party and 6-C application has been directed to be put up on 9th August, 2021 for disposal of objection.
Since the court below has already fixed the time on 9th August, 2021 for disposal of 6-C application, no further direction is required to be passed in this petition.
It is expected from the Civil Judge (Junior Division), Varanasi who is ceased with the matter, shall positively decide 6-C application on 9th August, 2021, after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties. However, due to any non avoidable reasons, the case is adjourned, 6-C application shall be disposed within the next six weeks.
With the aforesaid observations/ direction this petition stands disposed of.
