1. The petitioner has taken out present petition for below mentioned relief:
"8(a) To quash and set aside the impugned order dated 27-9-2011 passed by the Designated Officer in Reference No.1 of 2011 under the provisions of section 3 of the Gujarat Provision for Disqualification of Members of Local Authority for Defection Act, 1986;"
2. From the record, it transpires that the petition came to be filed on or around 11.11.2011 and was circulated for fist-admission hearing on 12.12.2011. On the first date of hearing, learned advocate for the petitioner requested for adjournment and the hearing was adjourned. Since then, the petition is being adjourned at the request of learned advocate for the petitioner and until now it has been adjourned from time to time. On 2.12.2011. Today also, request for adjournment is made. In the first session when the request was made, it was not granted. In the second sitting, when the petition is called out and taken up for hearing, again request for adjournment is made. Request is declined. The petition is being rotated on admission board and the petitioner does not appear to be anxious to prosecute the petition further, at this stage. Thus, the petition is dismissed for non-prosecution.
