Heard learned counsel for the petitioner and the learned Additional Government Advocate.
By means of this writ petition the petitioner has prayed for issuance of a writ of Mandamus commanding opposite party no. 2 to transfer investigation relating to case crime no. 971 of 2009, under Sections 420, 406 and 506 IPC registered at police station Chinhat, district Lucknow to some other investigating officer since the investigating officer of the aforesaid case, namely, Shri Abhimanyu Dhar Dwivedi is not investigating the case in its true spirit. It is submitted that on 29.04.2010 the petitioner had made a representation before the DIG/SSP, Lucknow to the said effect vide Annexure-3 to the petition, but till date no order has been passed.
In view of the aforesaid fact and since the prayer made seems to be trivial in nature, with the consent of the learned counsel for the parties, we dispose of of this writ petition finally with a direction to the DIG/SSP, Lucknow to look into the matter and if the investigation of the aforesaid case is not being properly done then transfer the same to some other investigating officer by passing necessary orders at an early date.
