Heard learned counsel for the applicant, Sri Vikas Sahai, the learned A.G.A. for the State, Sri Deepak Kumar Srivastava who appears for the informant and perused the record.
The instant application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicant in Case Crime No. 0021 of 2021, under Sections 304, 323, 352 IPC, Police Station Fafund, District Auraiya.
Sri Deepak Kumar Srivastava learned counsel has appeared on instructions of the informant. He draws the attention of the Court to the averments made in paragraph-21 with the applicant asserting that he is not involved in any case. According to Sri Srivastava, the applicant has deliberately failed to disclose his past criminal history and has made misleading statements.
Although Sri Yadav learned counsel appearing for the applicant has during the hearing orally apprised the Court that the applicant has been acquitted in two cases and that two cases have been withdrawn, the Court is constrained to observe that the applicant has failed to make a candid and fair disclosure as was required.
In view of the aforesaid, this application shall stand rejected.
