Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed challenging the impugned order dated 4.9.2019 passed by the respondent no. 4-District Supply Officer, District Firozabad.
By the impugned order the fair price shop licence of the petitioner has been suspended.
Challenging the impugned order, learned counsel for the petitioner submits that the petitioner is being harassed by the respondent authorities and it if for third time the licence of the petitioner has been suspended. Her licence, on every occasion, after consideration of reply, was restored. It is submitted that suspension orders have been passed in quick succession in the years 2017 and 2018 and this is third suspension. It is further pointed out that on every occasion complaints against the petitioner were found incorrect and false. He further submits that it is, however, not in dispute that the petitioner has already submitted her reply to the notice/suspension order.
In such view of the matter, present petition stands disposed of with a direction to the respondent no. 3-SDM/SDO Sirsaganj, District Firozabad to conclude the enquiry and pass appropriate orders, preferably within a period of one month from the date of production of certified copy of this order on its own merit after considering all the grounds that are being taken before this Court and/or any other ground that may be highlighted before the authority concerned.
In view of the allegation made in the petition, learned Standing Counsel is directed to send a copy of this order to the District Magistrate, Firozabad also.
No order as to cost.
