1. Heard learned counsel for the petitioner and learned Standing Counsel.
2. The solitary grievance of the petitioner is that her husband Dori Lal, who was in service, died on 15th March, 2019. Other than gratuity, terminal dues have been paid to the petitioner. More than 1 and 1/2 year has passed since then.
3. Arising from non payment of gratuity, the petitioner appears to have made representation dated 20.10.2020 before the respondent No.2 i.e. Deputy Director Madhyamic Shiksha, Bareilly Division Bareilly. The same is stated to be pending.
4. In view of the above facts, no useful purpose would be served in keeping the writ petition pending or calling for a counter affidavit at this stage. Without entering into the merits of this case, the writ petition is disposed of with the direction that in case the petitioner files a copy of this order before the respondent No.2 within a period of two weeks from today, the said authority shall pass appropriate order on the petitioner's representation dated 20.10.2020 (Annexure No.1 to the writ petition) within a period of one month therefrom. It further expected that the decision so made by the respondent No.2 shall be communicated to the petitioner in writing at her address disclosed in the writ petition along with the payment of admitted amount and interest payable thereon in accordance with law.
