Heard learned counsel for the applicants, learned AGA for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicants with the prayer that the A.C.J.M., Court No.4, Ghaziabad be directed to decide the Criminal Case No.3866 of 2014, under Sections 420, 467, 468, 471, IPC, P.S.
Niwadi, District Ghaziabad, pending before the A.C.J.M. Court No.4, Ghaziabad within stipulated period of time.
Learned counsel for the applicants has submitted that in the present case entire evidence has been recorded and the case has been fixed for recording the statement of the accused under Section 313, Cr.P.C. on 11.9.2018, however, since then the trial of the present case is being adjourned on one pretext or the other.
Considering the peculiar facts and circumstances of the case, trial court is directed to make all endeavour to conclude the trial as expeditiously as possible without giving any unnecessary adjournment to either party preferably within a period of three months provided there is no other legal impediment in concluding the trial.
