This appeal has been filed against the order dated 17.11.2018 passed by the Principal Judge Family Court, Banda, on an application filed under Section 24 of the Hindu Marriage Act in Case No. 104 of 2018 (Kamlesh Vs. Jeenu Devi), under Section 13 of the Hindu Marriage Act whereby the said application has been partly allowed and Rs. 1,000/- has been awarded to defendant-wife as maintenance pendente lite along with Rs. 1,000/- towards litigation expenses.
After arguing the matter for quite some time, learned counsel for the appellant has confined his prayer to the extent that the concerned court below may be directed to decide the Original Suit No. 104 of 2018 filed under Section 13 of the Hindu Marriage Act within a stipulated period. Thus the appellant has not pressed the present appeal on merits.
Heard learned counsel for the appellant and perused the record.
Considering the facts and circumstances of the case and the statement made by the learned counsel for the appellant, the appeal is hereby dismissed with a direction to the concerned court below to decide the Case No. 104 of 2018 (Kamlesh Vs. Jeenu Devi), under Section 13 of the Hindu Marriage Act pending before it in accordance with law expeditiously.
