By order dated 3.11.2017 in Writ-A No.51398 of 2017, this Court, while entertaining the writ petition, issued an interim mandamus to the third respondent to pay minimum in the pay scale of a regular employee to the applicant within three months or show cause within the same period.
It is not disputed that the respondents to the writ proceedings have shown cause by filing counter affidavit, although counter affidavit was filed with some delay.
Counsel for the applicant submitted that the applicant was entitled to regular pay scale of Class IV employee at least for the period till cause was shown.
However, this Court is unable to accept the said submission. Although there is technical contempt in not complying with the interim mandamus, as cause was not shown within three months, but in view of the admitted fact that thereafter cause has been shown by filing counter affidavit and there is no further direction by the Writ Court, consequently, this Court is not inclined to entertain the instant petition.
The contempt application stands disposed of accordingly.
