Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State- respondents.
Learned counsel for the petitioner does not wish to press first prayer as he concedes that the petitioner has no right. So far as prayer no.2 is concerned, the petitioner was allowed salary by the order of this Court dated 17.3.2015 in Writ Petition (SS) No. 3586 of 2011 only till the regularly selected candidate joins.
Now the petitioner is claiming that he should also be paid arrears of salary from the date of his initial appointment, i.e., from 2010 till the High Court has directed in 2011 for the payment of salary. That writ petition of the petitioner has been disposed of by order dated 17.3.2015. The petitioner could have made the prayer in the same writ petition for the payment of arrears of salary, what the petitioner is asking for today.
Once the petitioner having not prayed for in the earlier writ petition, no relief can be granted to the petitioner with regard to payment of arrears of salary prior to 2015.
The writ petition is mis-conceived and it is, accordingly, dismissed.
