Heard learned counsel for the petitioners and learned Standing Counsel for respondents no.1 to 6.
The petitioners claim to have been appointed as Junior Clerk in Irrigation and Water Resources Department between the years 1993 to 2009. According to the petitioners, they are eligible for promotion on the post of Junior Engineer (Civil). Papers have also been forwarded for promotion on the said post. However, a tentative list has been published by the department for promotion on the said post on 06.11.2020. Names of the petitioners did not find place. The petitioners being aggrieved by the said list, submitted representations dated 21.11.2020 for promotion on the said post to the respondent no.4-Chief Engineer (Karmik-7), Irrigation & Water Resources Department, UP, Lucknow, copy of the said representations are collectively enclosed as Annexure 4 to the writ petition.
Grievance of the petitioners is that the respondent no.4 is sitting tight over the matter and has not taken any decision for promotion of the petitioners on the post of Junior Engineer (Civil).
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.4 to consider the grievance of the petitioners.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed of with a direction to the petitioner to file a fresh representation before the respondent no.4-Chief Engineer (Karmik-7), Irrigation & Water Resources Department, UP, Lucknow, raising all their grievances within a period of two weeks from today. In case any such representation is filed, the respondent no.4 shall consider and decide the same by a reasoned and speaking order within a period of one month thereafter.
With the aforesaid observations, the writ petition is disposed off.
