Petitioner was employed in the office of respondent no.2 and has attained the age of superannuation on 30.06.2017. Grievance raised in this petition is that benefit of ACP scheme as per office memorandum dated 09.08.1999 as modified on 19.05.2009 has not been extended to her. It is also stated that difference of gratuity consequent upon implementation of Seventh Pay Commission Report has also not been extended. Various representations made in that regard are pending.
Sri Purnendu Kumar Singh, counsel for the respondent no.1 and Sri Jagdev Singh, counsel for the respondent no.2 states that petitioner's claim would be got examined by the concerned Director and an appropriate decision would be taken shortly.
In the aforesaid facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to petitioner's claim, noticed above, by passing an appropriate order, in accordance with law, within a period of two months from the date of presentation of a copy of this order. All the benefits which are found due and payable would be released to petitioner within a further period of six weeks, thereafter.
It is made clear that mere pendency of the writ petition filed by the Union would not be a ground to deny above benefit to the petitioner.
