1. Heard petitioner in person and perused the record.
2. The only prayer in this writ petition is that Central Administrative Tribunal, Allahabad Bench, Allahabad (hereinafter referred to as “Tribunal”) be directed to decide petitioner's Original Application No. 330/154/2017 expeditiously.
3. It is pointed out that looking to urgency of matter Tribunal has already passed order on 05.01.2018 allowing expedite application of petitioner and listed matter for hearing on 07.02.2018. Thereafter case has simply been adjourned on 07.02.2018, 07.03.2018, 10.03.2018 and 15.03.2018. Thereafter petitioner again moved an application for expeditious hearing but without any reason the same was rejected on 23.03.2018. Again the case has simply been adjourned on 05.04.2018 and now posted on 07.05.2018.
4. In our view, when Tribunal itself found that matter is urgent, needs expeditious disposal and allowed expedite application of petitioner, efforts should have been made by Tribunal to decide original application expeditiously and not to adjourn the matter frequently.
5. Tribunals have been constituted under Article 323 of Constitution with a pious objective that service matters of Central Government employees and other bodies notified under Administrative Tribunals Act, 1985 would be decided expeditiously but it is realy disturbing that instead of achieving said objective, order sheet of case shows that matter is being adjourned from time to time even when applicant's counsel was present for most of time and it is respondents who either did not present or sought adjournment. This situation is not appreciable.
6. We, therefore, dispose of this writ petition with a direction to Tribunal to decide Original Application No. 330/154/2017 at an early date and if possible on the next date, i.e., 07.05.2018. If it is not possible to decide original application on the next date, then the same shall be decided within a reasonable time thereafter but not beyond a period of one month from the date of production of a certified copy of this order.
